These conditions of sale are concluded on the one hand by the micro-entrepreneur Nicolas Voisard whose head office is located at 72 chemin de Tregont Mab, 29000 Quimper, registered in the Quimper Trade Register and managing the site www.atelier-rehab .com and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.atelier-rehab.com hereinafter referred to as "the buyer".

Preamble

 

Nicolas Voisard sells objects, furniture and fittings on his website www.atelier-rehab.com. The list of products sold and available can be viewed on www.atelier-rehab.com.

 

Article 1. Purpose and general provisions

These conditions of sale aim to define the contractual relationship between Nicolas Voisard and the buyer and the conditions applicable to any purchase made through the website www.atelier-rehab.com.

The GTC can be viewed on the website www.atelier-rehab.com. At the time of purchase, the buyer declares to have read the GTC and to accept them without restrictions or reservations by checking a box with a validation click.

The buyer declares to have full legal capacity, allowing him to engage under these general conditions of sale.

The micro-entrepreneur Nicolas Voisard retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of his site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those which appear on the site www.atelier-rehab.com, within the limits of available stocks. The micro-entrepreneur Nicolas Voisard reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description showing its main technical characteristics. The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products presented on the site www.atelier-rehab.com is intended for all buyers resident in countries which fully authorize the entry into their territory of these products.

Article 3. Prices

​

The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The micro-entrepreneur Nicolas Voisard reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total weight of the order.

The shipping costs are indicated at the time of the order in euros (€) all taxes included (TTC). They vary depending on the content of the order.

Article 4. Conclusion of the contract online

​

The Customer must follow a series of steps specific to each Product offered by the Seller in order to be able to place his order. However, the steps described below are systematic:

  • Information on the essential characteristics of the Product;

  • Choice of the Product, if applicable of its options and indication of the essential data of the Customer (identification, address ...);

  • Acceptance of these General Conditions of Sale.

  • Verification of the elements of the order and, if necessary, correction of errors.

  • Follow-up of instructions for payment, and payment for products.

  • Product delivery. The Customer will then receive confirmation by email of payment for the order, as well as an acknowledgment of receipt of the order confirming it. For the delivered products, this delivery will be made to the address indicated by the Customer. For the purposes of successful completion of the order, and in accordance with article 1316-1 of the Civil Code, the Customer undertakes to provide his true identification elements. The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.

 

Article 5. Retention of title

The micro-entrepreneur Nicolas Voisard retains full ownership of the products sold until the price has been fully collected, in principal, costs and taxes included.

Article 6. Withdrawal

​

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty. The return costs will however remain entirely the responsibility of the customer.

Article 7. Delivery

​

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Delivery times are only indicative; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The micro-entrepreneur Nicolas Voisard can provide the buyer with the tracking number of his package by e-mail. The buyer is delivered to his home by the delivery man chosen by the micro-entrepreneur Nicolas Voisard. The buyer is required to be at his home at the time of delivery. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the micro-entrepreneur Nicolas Voisard. The buyer is required to check in the presence of the deliveryman, the condition of the packaging of the goods and its contents on delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Guarantee

​

All the products supplied by the micro-entrepreneur Nicolas Voisard benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the micro-entrepreneur Nicolas Voisard who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made electronically to the following address: hello@atelier-rehab.com, within thirty days after delivery.

 

Article 9. Liability

​

The micro-entrepreneur Nicolas Voisard, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.

 

Article 10. Intellectual property

​

All the elements of the site www.atelier-rehab.com are and remain the intellectual and exclusive property of the micro-entrepreneur Nicolas Voisard. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

Article 11. Personal data

​

the  micro-entrepreneur Nicolas Voisard undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Force majeure

​

The micro-entrepreneur Nicolas Voisard reserves the right to modify, delay or suspend the execution of the order in cases of force majeure, as defined by case law, as well as in the case of characterized events leading to a impossibility of execution such as strikes, lockouts, fires, floods, freezes, blockages of communication routes ...

Article 13. Settlement of disputes

​

These distance selling conditions are subject to French law. For all disputes or litigation, the competent court will be that of Quimper.
